The action was in trespass to try title, brought by appellant's intestate against Shaw and others to recover a league of land in Harrison county, granted to Henry Harper on the 13th October, 1835. The variety of questions presented by the pleadings during the twenty-eight years’ litigation in this case requires a statement of the principal points presented by the pleadings, and a comparison of or reference to the most important facts adduced on the trial.

The original plaintiff, Albert Sidney Johnson, brought suit in the District Court of Harrison county, at the fall term, 1845, to recover, as owner, the league of land granted to Henry Harper.
