LANNING, Circuit Judge.

On March 19, 1907, Wilbert Beaumont, contractor, and John Purdy Cope, owner of the Water Gap House, at Delaware Water Gap, Pa., entered into a written agreement, by which Beaumont agreed to make certain alterations and additions to the Water Gap House “under the direction and to the satisfaction of S. Hudson Vaughn, architect, acting as agent for the owner.” The contract price for the work was $22,710. Seven partial payments, aggregating $12,500, were required to be made during the progress of the work. It was provided that the eighth and final payment of $10,-210…
