On November 13, 1906, Dan Price (hereinafter called the defendant) was indicted by the grand jury of the Central District of the United States Court for the Indian Territory, sitting at Atoka, for the murder of one Naith Dillingham, alleged to have been committed on the 3rd day of July, 1906.
