I. Introduction and Background

Now before the Court is Adams’ motion to set aside default (Doc. 44). Christiansen objects to the motion (Docs. 46 & 47). Based on the following, the Court GRANTS the motion to set aside default and DENIES as moot Christiansen’s motion for default judgment (Doc. 35).

On August 12, 2004, Plaintiff filed this lawsuit pursuant to 42 U.S.C. § 1983, alleging in six counts that he suffered numerous constitutional violations at the hands of ten defendants employed at Big Muddy River Correctional Center (“BMRCC”). On February 25,…
