The parties hereto occupy the same position as in the trial court. The plaintiff procured a judgment against the defendant in the district court of Pontotoc county, Okla., which is unpaid. After execution was issued and returned unsatisfied, the plaintiff caused garnishment summons to be regularly issued and served upon the Fidelity National Bank of Oklahoma City. The garnishee answered that it was indebted to the defendant in the sum of $192.83.
