Proceedings were instituted by plaintiff in error, under chapter 31 of the General Laws, for the condemnation of certain lands belonging to defendants in error. Various steps were taken in pursuance of the provisions of said act, which culminated in the filing of a report by commissioners, determining the amount of compensation or damages to be paid for the premises. A motion was made by plaintiff, in error to set aside and vacate the said report and findings of the commissioners, but the judge overruled the same, and denied petitioner a reassessment of damages.
