This is an appeal from the district court of Oklahoma county. The facts material to a correct determination of this appeal are as follows: The defendant in error Vollers was indebted to the plaintiff in error, Zeiglar, as evidenced by two notes aggregating the sum of $166. one note bearing date of September 9, 1911, for $86, and the other bearing date of December 28, 1911, for $152, on which certain payments had been made.
