This action was brought by John A. Caldwell against the Transport Corporation, alleged to be a foreign corporation doing business in Nashville, to recover damages for injuries to his person and his automobile resulting from a collision with a truck of the defendant on January 5, 1932. The summons was issued on January 27, 1932, and on April 23, 1932, it was served on “F. J. La Barba of the Transport Corporation.” No declaration was filed until February 10, 1933.
