Appeal (1) from an order of the Supreme Court at Special Term, entered March 18, 1976 in Schenectady County, which granted a motion by defendant for summary judgment dismissing the complaint and (2) from the judgment entered thereon. On March 15, 1971 plaintiff Frances Gizzi was involved in an automobile accident with an uninsured motorist. On March 22, 1971 a representative of the defendant contacted the plaintiffs, took a recorded statement from Frances Gizzi and photographed the insured vehicle.
