CROCKETT, Justice.

This is an action for personal injuries to plaintiff and damages to his car.

On the afternoon of October 9, 1948, the plaintiff, John Galarowicz, had parked his car parallel to the curb and facing east on the south side of Emerson Avenue in Salt Lake City and was removing merchandise from the north side of said car when the defendant’s automobile came backing out of the driveway across the street and crashed into the plaintiff, causing injuries to himself and damage to his car.
