This is a complaint under the R. L. c. 102, § 1, charging the defendant with assuming to be a common victualler without first obtaining a license as required by other provisions of this chapter. At the trial in the Superior Court the jury returned a verdict of guilty, and the case is before us on his' exceptions to the refusal of the court to rule as requested, and to the instructions given to the jury.
