MEMORANDUM OPINION AND ORDER ON DEFENDANTS’ MOTION TO DISMISS

I. BACKGROUND

This action was commenced by the filing of a Complaint on June 14, 2005. The plaintiffs are Laura A. Heimlicher and Lawrence W. Heimlicher, both individually and as Administrators of the Estate of their deceased infant son, Cole C. Heim-licher. They are residents of Spirit Lake, Dickinson County, Iowa.
