On October 5, 2005, oral argument before the undersigned United States District Judge was heard on Plaintiff Teresa Payzant’s (“Plaintiff’ or “Payzant”) Motion for Summary Judgment [Docket No. 25] and Defendant UNUM Life Insurance Company of America’s (“Defendant” or “UNUM”) Motion to Dismiss and for Summary Judgment [Docket No. 43].
