In an action to recover damages for personal injuries, the defendant *629appeals, as limited, by its brief, from so much of an order of the Supreme Court, Queens County (Lane, J.), dated November 7, 1994, as denied its motion for summary judgment dismissing the complaint.

Ordered that the order is modified, on the law, by deleting the provision thereof which denied the branch of the defendant’s motion which was for summary judgment dismissing the plaintiffs Labor Law § 200 (common law negligence) cause of action, and substituting therefor a provision granting that branch of the motion; as so…
