Appeal by the defendant, Thomas Putnam, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county'of New York on the 23d day of June, 1903, upon the verdict of a jury convicting the defendant of the crime of grand larceny in the first degree.

Ingraham, J.:, The defendant was indicted for grand larceny in the first degree. He was duly convicted, and the main question upon this appeal is whether the proof justified that conviction.
Section 528 of the Penal Code provides that a person is guilty of larceny who, “ with the intent to deprive or defraud the true owner of his property, or of the use and benefit thereof, or to appropriate the same to the use of the taker, or of any other person, either : 1.
