Appeal by the defendant, Philip Weinseimér, from a judgment of the Court of General Sessions of the Peace in and for the county of New York, rendered on the 14th day of November, 1904, convicting the defendant of the crime of extortion.

The charge upon which the defendant was convicted is, in,effect, that on the 31st day of December, 1903, he,, then being president of a labor union, obtained from one George J. Essig the sum of $1,000 in money and seven promissory notes, aggregating $1,700., by fear induced by a threat made to Essig, who had a contract for the plumbing work on “ The Chatsworth ” apartment house on Seventy-second street, near Riverside Drive, owned by the JohnsonEahn Company, that unless said sum of money and notes were delivered to the defendant work could not be resumed on the contract, the men…
