Foster v. Cramer

Appeal from the District Court of Arapahoe County. This is an action brought by H. E. Foster against Fred Cramer, sheriff of Arapahoe county, and the Solis Cigar Company, to recover possession of certain personal property. The case was tried to the court and judgment rendered for defendants. Plaintiff brings the case here on appeal.

The facts disclosed by the record which are pertinent to the questions presented for our consideration are in brief as follows:
On the. 13th day of March, 1886, one J. D. Scott conveyed to plaintiff, by a chattel mortgage, the personal property in controversy to secure the payment of a certain promissory note of even date therewith, for the sum of $5,000, payable on or before March 14, 1887. This chattel mortgage was dated March 14,1886, but, as a matter of fact was executed, acknowledged and filed for record in the recorder’s office on the 13th.
