At the close of the plaintiff’s evidence the appellant company asked of the court a written instruction, instructing the jury that the evidence in the case was not sufficient to maintain appellee’s case, and that the jury were therefore instructed to find the issues joined in favor of the appellant. This instruction was refused. Again, at the close of all the testimony the appellant asked the court to give the same instruction in writing, which was refused.
