On the former hearing, it was determined, that the real estate in question was advanced by Sigourney as part of the company’s stock, or purchased for the accommodation of the partnership business; and that these facts made it partnership fund.
The plaintiff has alleged in his bill, that there was a balance due to him, as partner, on the adjustment of the partnership concerns ; and in proof of this, he has relied on a valuation of the goods and estate of the partnership, by the estimate of witnesses.
