SCHROEDER, Justice.

Eric Evensiosky (Evensiosky) appeals the district court’s order summarily dismissing his petition for post-conviction relief. The *190Court of Appeals reversed the district court and remanded the case for further proceedings. This Court granted the state’s petition for review. The decision of the district court is affirmed.
