This is an action on a fire insurance policy brought by the plaintiff, Gordon, against the defendant, Continental Insurance Company. Judgment was rendered for the defendant on its demurrer to the plaintiff’s ■ evidence. The policy covers a hou¡¡e in the sum of $500, household and kitchen furniture in the sum of $300 and other personal property not involved herein. On January 26, 1933, the house and contents were destroyed by fire. Settlement was made as to the personal property, so only the loss as to the real property is involved in this action.
