Northwestern National Life Insurance Company, as a landowner, brought this action against C. Bruce Young, Western Seeds, Inc., and Ray and Thirza Douthit to recover the value of its share of soft white wheat harvested from Northwestern’s property by the Douthits. A trial without a jury began, but was recessed after presentation of the plaintiff’s case to permit the Douthits to amend them pleadings and to provide Northwestern the opportunity for responsive discovery.
