This is a proceeding under the Nebraska Workmen’s Compensation Act. The plaintiff was an employee of Grosshans Lumber Company, a corporation, hereinafter referred to as the defendant or lumber company. The other defendant was the insurance carrier for Grosshans Lumber Company. Following a hearing before a single judge of the workmen’s compensation court, the action was dismissed. The plaintiff then appealed directly to the district court for Hamilton County which, after trial, entered an order of dismissal.
