This case originated in the district court of Pecos county, where there was a trial to a jury answering special issues, upon which a judgment was renderedtin accordance therewith, in favor of the original plaintiffs, who are the plaintiffs in error here. Upon ap^ peal to the Court of Civil Appeals at El Paso, the judgment of the district court was reversed, and in part rendered and in part remanded, for a new trial.’ 25 S.W.(2d) 989.
