The appellant and defendant below, Cegar Conn, with his brother, Allie Conn, were jointly indicted by the grand jury of Carter county, in which they were accused of murdering Walker Ross, who was shot and fatally wounded in a battle between him and the two defendants, fought on May 8, 1931, in the village of Limestone, in Carter county, Ky., between 4 and 5 o’clock p. m. At his separate trial appellant (to whom we shall hereafter refer as defendant) was convicted of voluntary manslaughter, and punished by confinement in the penitentiary for 21…
