This case comes before the Court on Defendants’ Pleas in Bar. The matter was heard ore tenus on June 18, 1992. The Court took the Pleas in Bar under advisement to consider more fully the issues presented. This case arose from a construction-site accident that led to the death of Ricky C. Brown. On October 3, 1988, Mr. Brown was assisting in moving a piece of equipment into the partially constructed warehouse and offices of his employer, HVAC Systems of Virginia, Inc.
