Quillian, Judge.

Insofar as the motion for summary judgment on Count 1 is concerned we consider the question: did the record reveal there was a genuine issue of fact as to whether the defendant Green and the defendant Jones’ intestate, Kay *467Langley, were changing drivers at the time of the accident as alleged in the petition?
