(dissenting) : This is an action for personal injuries sustained by the respondent while walking on Broad Street of the City of Greenville. The complaint alleged that the appellant was engaged in the construction of a building for the Greenville News-Piedmont Company and had been given permission to erect a fence on a portion of the street during construction.
