Tbe controversy between tbe parties is equitable in its character, and ended in a failure of tbe plaintiff to establish tbe charges in her bill; and the same was accordingly dismissed. Tbe answer of tbe defendants was in tbe nature of a cross-bill, which was also dismissed, against tbe protest of the defendants, upon tbe ground that tbe dismissal of tbe original bill worked a discontinuance of tbe whole controversy.
