This appears to be a case of first impression in Connecticut.

The following facts are undisputed. On June 3, 1994, at approximately 2:30 p.m., the plaintiff Arshon Thomas (plaintiff who was then fifteen years of age, was a passenger in a motor vehicle driven by a fellow student, Christopher Quealy. Quealy lost control of the automobile causing it to flip over onto its roof and crash into a tree causing the plaintiff to sustain personal injuries.
