The respondent was tried in tbe probate court in and for the county of Ada, upon a complaint charging him with the offense of conducting a faro game, as employee of another, was convicted, and sentenced to pay a fine of $200. From said judgment of conviction the respondent appealed to the district court in and for said Ada county.
