The People offered the purported oral confession and admission of a codefendant, which inculpated this defendant in the commission of the crime, in evidence at the trial as declarations against penal interest. The codefendant was tried separately and convicted of two counts of murder in the second degree. While the declaration against penal interest exception to the hearsay rule has been the subject of several recent criminal decisions, this court believes that the issue presented in this case is one of first impression in the courts of this State, except…
