This suit was brought by the appellant against the appellee, and the complaint, in substance, is, that on the 18th day of March, 1871, a certain piece of land belonging to and owned by the plaintiff was sold by the sheriff on a decree, and that the defendant purchased it for four hundred and nine dollars and eighty-one cents, being the exact amount due on the decree; that the land at the date of the *499sale was worth one thousand dollars; that within a year .after the sale he paid to the defendant four hundred dollars, which was paid to and received by the defendant, for the redemption of said…
