This is an action for a judgment declaring that plaintiff is entitled to the coverage of an automobile liability insurance policy issued by defendant Allstate Insurance Company to one Carl Tamorria.

In Queens County, there is a restaurant known as Tufaro’s Restaurant. Adjoining it is a parking lot which holds 30 cars.
