ROGERS, J.

Under a mineral lease from the state of Louisiana defendant drilled an oil well in the bed of Black bayou in sec. 13, T. 21 N., R. 15 W., Caddo parish.

The well was brought in as a producer, and thereafter plaintiff filed this suit, alleging that he was in actual possession, as owner, of Sec. 12, T. 21 N., R. 15 W., Caddo parish, and that he was the holder of a mineral lease covering a tract of land in the northeast quarter of section 13, same township and range; alleging that there runs through the lands in sections 12 and 13 “a shallow and nonnavigable stream…
