Appeal from a judgment of the'superior court for Whitman county, Canfield, J., entered July 2, 1910, upon a trial and conviction of the crime of larceny by embezzlement.

— The prosecuting attorney of Whitman county, by information, charged the defendant, H. M. Boone, with *332the crime of larceny by embezzlement. On trial the jury found him guilty, and he has appealed from the final judgment and sentence. The information in part charges:
