Pursuant to leave granted at the October term, 1927, the relator, J. Bert Miller, filed in this court a petition against H. E. Fullenwider, State’s attorney of Sangamon county, for a writ of mandamus commanding him to sign and present to the circuit court of Sangamon county a petition for leave to file an information in the nature of quo warranto against Len Small, requiring him to show by what warrant he claims to hold and execute the office of Governor of the State of Illinois.
