On exceptions. The case was tried before a jury in the Superior Court, within and for the County of Androscoggin. Defendant requested an instruction to be included in the charge of the presiding justice to the jury. The requested instruction was refused and the defendant took exceptions to the refusal. The case involves the collision of two motor vehicles which took place on Cushing Street, a public street in the City of Auburn. The accident happened on the morning of January 7, 1958.
