Plaintiff Tzvee Rotberg brings this action on behalf of a putative class of individuals who he alleges have received certain text messages from Defendants Jos. A. Bank Clothiers, Inc. ("JAB") and Vibes Media, LLC ("Vibes") in violation of the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227 et seq. (Dkt. No. 13 ("FAC") ¶ 1.)
