MEMORANDUM & ORDER
PLATT, District Judge.
On May 27, 1978, Thomas Cusanelli was allegedly injured during an attempt to re-float a grounded vessel, the EL MAR II (El Mar), owned and operated by Leonard Klaver, when a stern towing cleat “ruptured and ripped off” the El Mar and “cata pulted” into his body. Complaint ¶ 13. At the time of the injury, Mr. Cusanelli was on active duty with the Coast Guard on board vessel CG 413-49.
