John Wagner died intestate December 27, 1926, seized of the legal title to a four-acre tract located on Indianola and Evergreen Avenues in Des Moines. He was survived by Ms widow, the appellant, and two brothers, ,,T. ' , „ ’ Z, ■ ■ -, Will and George. This action was commenced jn 1927, by William against the appellant only, to have a trust to an undivided one-third interest impressed upon the above property, and to quiet title thereto'.
