The railway company was sued for the negligent killing of three mules, which were run over by a passenger-train. The negligence alleged was: (1) the failure of the engineer and emploj^ees of the defendant company to keep a proper lookout; (2) the failure to exercise ordinary care and diligence to bring the train to a stop after the mules were discovered on the track; (3) the failure to blow the whistle and ring the bell; (4) the failure to check the speed of the train; and (5) the running of the train at a high and reckless rate of speed.
