Dissenting. — Idaho Code Annotated, sec. 35-116, provides that the employees of the fish and game department, including the chief clerk, “shall be paid from the fish and game fund upon their sworn statement, which accounts shall be approved by the state fish and game warden.”

Monthly payrolls were submitted to Mr. Gallet, then state auditor, signed by respondent as a receipt for -the amount of salary she claimed was due her.
