After Bank of America, N.A. (“BOA” or “the Bank”), was served with a garnishment action naming Celio O. Burrowes as the defendant, the Bank stopped payment on a cashier’s check which was purchased with funds from Burrowes’s BOA checking account and which named Burrowes as the payee. Burrowes then filed suit against BOA in Fulton County Superior Court, asserting that the Bank had wrongfully refused to honor the check in violation of Georgia’s Commercial Code.
