MEMORANDUM AND ORDER

LAGUEUX, Chief Judge.

This is a suit to recover delinquent employer contributions to employee benefit plans under the Employee Retirement Income Security Act of 1974 (“ERISA”). The plaintiffs, Local 57 of the International Union of Operating Engineers (“Local 57”) and the trustees of certain funds maintained by Local 57, seek to collect the unpaid contributions under a labor and materials payment bond posted to secure an employer’s obligations in a public construction project.
