Defendant was convicted of the murder of Charles C. Clauson under count one of the information and his sentence fixed as second degree murder, and of assault with a deadly weapon of one Lee Clauson under count two thereof. The deceased, Charles C. Clauson, was a barber and had been acquainted with the defendant who operated a bar and café in San Bernardino for many years. Lee Clauson, 30 years of age, was a son of deceased.
