Jacob Smiley was married four times. By his first wife, Catherine, he had four children, Joseph J., Jonathan H., James and Elizabeth. By his second wife he had no children. In 1870 he married his third wifi', Mary. On the 26th day of September, 1873, he became the owner of the land in controversy. On.that day he and his wife executed five deeds, one to his daughter, Elizabeth, one to his son Jonathan H., one to Joseph and Jonathan, one to Joseph, and one to the heirs of James Smiley.
