Pending before the Court is a motion to dismiss filed by Plaintiff and Counter-De fendant RaceRedi Motorsports, LLC (RaceRedi), Paper No. 14, and a motion to dismiss filed by Third-Party Defendant Finishes, Inc. (Finishes). Paper No. 17. These motions are fully briefed. Upon a review of the motions and the applicable case law, the Court determines that no hearing is necessary (Local Rule 105.6) and that the motions will be granted in part and denied in part.
