On January 27, 1949, an action for mandamus was filed in the circuit court of Cook County, on the relation of certain individuals alleged to be residents and qualified voters of the town of Cicero, seeking to compel the president and trustees of the town of Cicero to submit to the electors of said town the question whether it shall incorporate as a city under the provisions of article 2 of the Revised Cities and Villages Act.
