The appellant filed in the circuit court of Cook county an information in the nature of quo warranto, upon the relation of the State’s attorney for the county of Cook, in which it was alleged the appellee, without legal right or warrant so to do, holds and executes the office of town clerk of the town of Cicero, and praying said appellee be required to answer by what warrant he claims the right to discharge the duties of the said office.
